1. GENERAL TERMS AND CONDITIONS - IDENTITY OF THE COMPANY

2.1. Our General terms of sale are applicable to every offer we make as a web shop to you as a consumer (every natural person who, exclusively for non-professional goals, uses or acquires products and services that where brought on the market).
2.2. We only deliver in Belgium and the Netherlands. If you enter a delivery address in another country, we retain the right to refuse your order.
2.3. The minimum age to place orders with us is 18 years. If you have not reached the age of 18 yet, we kindly request you to ask your parents or legal guardian to place the order. If we notice an order is being placed by a minor, we retain the right to refuse this order.
2.4. Placing an order implies your explicit acceptance of our general terms of sale, which can be consulted permanently through our website.
2.5. When you place an order online, a copy of the general terms of sale will be sent together with the confirmation of delivery or at least with the delivery itself. This will be in a format you can save or print. We advise you to do this at any time.
2.6. If additional particular terms of sale apply apart from the these general terms of sale, all of the above also applies to those particular terms. As a consumer you have the right to apply the most beneficial terms in case there would appear any contradictions between the general terms of sale and the additional particular terms of sale.
3. OUR OFFER AND YOUR ORDER
3.1. We will always stipulate explicitly in our offer whether an offer only stands for a limited amount of time or if the offer is subjected to certain conditions.
3.2. We always describe what we sell to you as complete and accurate as possible. In any event, the description is detailed enough for you to make a proper assessment of it. In case we use images, these will be a representative display of the offered products and/or services. However, if we make an obvious mistake, as mistakes are only human, we are no longer obliged to deliver to you.
Your order is completed and the arrangement between us is final once we confirm your order by e-mail and once we receive the approval of the issuer of your credit or debit card for your payment transaction. We accept Visa, MasterCard and Maestro. We cannot be held responsible for any delay of your delivery and/or non-delivery of your order, in case the issuer of your card refuses to agree with your payment to us. Orders without valid payment by the registered cardholder will not be accepted nor processed.
3.3. In order to buy a product, you have to add the product to your shopping cart. Afterwards, you enter your contact and billing information. Subsequently, you choose the manner of delivery and the deliveryaddress of your choice. In a last step you will get an overview, you will accept our General terms of sale and confirm your payment. If you accept those, your purchase will be final.
4. COOLING OFF PERIOD
4.1. If you purchase our products, you will have the right to return the products within 14 days starting from the delivery. You can return your order without paying a fine or without giving a reason (you will pay the costs of it yourself). Within 14 days after we retrieved your order, we will reimburse the full purchase price.
4.2. During the first 14 days after delivery we expect you to handle your order and package with care. If you intend to return the goods, as described above, you can only unpack or use them in order to assess whether you wish to retain the goods or not. Returned goods can be fitted, but not used. In case you return the goods, you should do so in the original packaging, with all the accessories and in their original state and taking into account our instructions set out below.
4.3. You can return your package by postal or courier service. Your order will be refunded by the same payment method you used for your purchase.
5.1. During the period we mention in our offer, we do not modify our prices, unless there is a price change as a consequence of changes in the VAT-rates.
5.2. Our prices include all taxes, VAT, taxes and services. You will never be taken by surprise. Although we can decide to add a shipping fee on top of the purchase price. In that case we will inform you before you place your final order.
5.3. Shipment fees are free for home delivery orders over 50 €. For orders under 50 €, a shipping fee of 3.95 € will be charged for home deliveries.
6.1. We can only accept payment through the methods of payment on our website. Payment by remittance or by C.O.D. are not possible.
6.2. In order to guarantee a secure online payment and in order to guarantee the security of your personal data, the transactions data will be sent through the internet encrypted with SSL technology. In order to pay with SSL, no specific software is needed. You recognize a secure SSL connection by the lock in the status bar below of your browser.
7. CONFORMITY AND GUARANTEE
7.1. We guarantee that our products will match your order and will satisfy your normal expectations given the specifications of the product. We also guarantee that our products meet the requirements of applicable laws at the time of your order.
8. DELIVERY AND EXECUTION
8.1. All goods will be delivered to the address provided at the time of the order. Delivery is only possible to a Belgian or a Dutch address.
8.2. Your order will be delivered within 3 business days.
8.3. Deliveries are scheduled during office hours from Monday until Friday (except on holidays).
8.4. Shipment fees are free for home delivery orders over 50 €. For orders under 50 €, a shipping fee of 3.95 € will be charged for home deliveries.
8.5. We ship by courier service GLS. The evening before delivery, GLS will send you an e-mail. With this e-mail, you are able to change the delivery details such as the address or time. You can also inform that you do not wish to sign for the package and give your approval to leave it around the house, e.g. under the carport. Please be aware that by choosing this last option, delivery will be at your own responsibility. you can also choose to pick the package up yourself at a GLS depot.
8.6. If you are not home, GLS will try to deliver at one of your neighbours and will notify you with a message in your letterbox. If it wasn’t possible either to deliver at your neighbours, GLS will inform you as well with a notice in your letterbox. With this document, you can again change your delivery address or moment, indicate your choice to pick up your item at a GLS shop, etc. After two delivery attempts without success, GLS will return your item(s) to the F.R.E.D. webshop after which your purchase will be refunded.
8.7. If we are not able to deliver within the agreed time, you will be notified before the delivery term expires. If we fail to deliver within the agreed time, you can decide to cancel your order and you will be refunded within 15 days after cancellation.
8.8. Transport of your order is always at our risk, except when you choose delivery method without proof of delivery. However, when you decide to return items to the webshop within 14 days after purchase, transport responsibility lies with you.
8.9. In case delivered goods are damaged during transport, goods do not correspond with the products mentioned on your delivery form or goods do not correspond with the products you ordered, you should notify us as soon as possible and no later than 3 days after receiving your package. You should then return the goods within 14 days after reception by using the attached return form. 8.10. We cannot be held responsible for consequential damage due to late delivery or non-delivery by the courier service that we use. In that case, our responsibility is limited to the products which are proven not to be received by the client.
9. FORCE MAJEURE
9.1. In case of force majeure, we are not obliged to fulfill our obligations. In that case we can suspend our obligations while the force majeure lasts or we can definitively dissolve the arrangement.
9.2. Force majeure is every circumstance beyond our control that prevents the fulfillment of our obligations, either partially or entirely. Force majeure can be seen as: strikes, fire, business interruption, energy interruption, interruptions in (telecommunication-) network or connection or used communication systems and/or the malfunction of our website, late or non-delivery of the suppliers or other engaged third parties.
10. INTELLECTUAL PROPERTY
10.1. Our website, logo’s, text, photos, names and in general every communication is protected by intellectual property rights that are with our suppliers or other stakeholders.
10.2. It is forbidden to make use of and/or change the intellectual property rights as subscribed in this article. For instance drawings, photos, names, texts, logo’s, color combinations, etcetera … cannot be copied nor reproduced without prior and explicit written permission.
11. SETTLEMENT OF COMPLAINTS AND DISPUTES
11.1. We always hope that our clients enjoy 100 % satisfaction. In case you do have complaints about our services, do not hesitate to contact us through email@example.com. We will do everything in our power to treat your complaint within 7 days.
11.2. Belgian Law applies with the exclusion of any other national law to all our contracts with our clients, notwithstanding their place of residence. Belgian courts have exclusive competence in case of any dispute. If in case of reasons of International law another law would apply, there will always be referred to the Belgian Law of Commercial Practices and Consumer Protection when interpreting the current general terms of sale.
